General terms & conditions
1. The coaching/counseling process will be treated with the utmost confidentiality. As long as it is in line with good professional practice and does not conflict with legal rules or other obligations, details regarding the person of the coachee and the nature and scope of the matters will only be shared with others if the coachee has given permission. More information about this can be found in the Privacy Statement.
2. The methods used are tailored to the personal themes addressed in the sessions and consist of reliable and validated instruments.
3. All exercises, programs, models, and other materials of any kind distributed to support the coaching/counseling process remain the intellectual property of the coach/counselor at all times. Any use beyond personal use by the coachee will be invoiced separately as the sale of training material.
4. Both midway through and at the end of the process, an evaluation takes place in which the process is assessed, and the goals are reviewed for relevance.
5. The client pays the coach/counselor an amount per session. The amount is agreed upon in advance by the coach and the client and is paid within 14 days of the invoice date.
6. If unable to attend, a scheduled session must be canceled at least 24 hours in advance. The coach/counselor may charge for the missed session if the client fails to cancel in a timely manner.
7. The coach/counselor adheres to the provisions of the WGBO (Dutch Medical Treatment Contracts Act) and the ethical and other professional codes applicable to their profession.
8. The coach/counselor is not liable for any adverse consequences that arise because the client provided incorrect or incomplete information, or because the client did not provide information available in medical records from doctors/specialists or other healthcare providers.
9. Participation is at the client's own risk. The client is responsible for monitoring their own psychological and physical boundaries. If physical and/or psychological issues arise, we will refer you to your general practitioner/treating physician or an appropriate and specialized therapist.
10. The agreement can be terminated in the following ways:
a) The client indicates that the agreed number of sessions has been completed and they wish to end the coaching;
b) The client indicates that they wish to end the coaching;
c) The client sends the coach/counselor a letter or email indicating they wish to terminate the agreement and stating the effective date;
d) The coach/counselor sends the client a letter stating that the agreement has been terminated.
This is done by the coach/counselor only when:
- The client repeatedly fails to respond to written or telephone contact attempts by the coach;
- The client has indicated that they do not wish to adhere to the jointly developed action plan;
- The client repeatedly fails to comply with the general provisions of this treatment agreement or the agreements made between the client and the coach during the sessions;
- The coach/counselor believes that due to the client's issues and the coach/counselor's competencies, they are not competent to guide the client. This is certainly the case when the issues are directly related to contraindications.
11. The government has legally established what must be done if people have complaints about care. This is stated in the Healthcare Quality, Complaints, and Disputes Act (Wkkgz). At Agata Dijkstra Counseling & Coaching practice, this is arranged as follows: If you are not satisfied with my work, it is important that you are heard. Complaints can not only disrupt our personal working relationship, but they can also bring important elements of the counseling process to the table. By discussing them together, we can clarify what is happening and how we can deal with it together. Experience shows that a good conversation between the client and the care provider works best. We will likely come to a solution or adjustment of the process. As a registered member of the professional association NFG, I am subject to the Wkkgz regulation at Quasir.
